Gecco Blinds – Terms & Conditions
Thank you for choosing Gecco Blinds for the supply and installation of your new window furnishings. The supply and installation of your window furnishings will be governed by these terms and conditions as read in conjunction with the terms of any written Quote provided to you by us. Please carefully review both the Quote and these terms and conditions before placing your order.
Australian Consumer Law Rights:
These terms and conditions are subject to any statutory consumer guarantees under the Australian Consumer Law and any other relevant legislation which cannot be excluded. Information regarding your rights under the Australian Consumer Law can be found by visiting the Australian Competition and Consumer Commission (ACCC) website at: https://www.accc.gov.au/consumers.
1. Defined Terms
In these terms and conditions, the following terms have the following meanings:
1.1 “Goods” means the window furnishings and any components and hardware supplied with the window furnishings;
1.2 “Premises” means the premises on which the Goods are to be installed;
1.3 “Quote” means any written quotation provided by us to you in respect of the supply and installation of the goods;
1.4 “us” and “we” means Gecco Blinds;
1.5 “Warranty” means the warranty in clause 6 of these terms and conditions;
1.6 “you” means the customer.
2. Quotes
All Quotes provided by us for the supply and/or installation of the Goods are estimates only and remain valid for a period of 30 days from the date of the Quote. We reserve the right to withdraw or vary our Quote if your requirements change or if any information provided by you to us is incorrect.
3. Our Responsibilities
3.1 We will supply and install the Goods in accordance with the Quote.
3.2 Whilst we will make all reasonable efforts to ensure that the Goods match the sample chosen by you, there may be variations in the Goods due to differences in production runs and variations in natural materials.
3.3 In accordance with the Australian Consumer Law, we warrant that the Goods supplied will be free from defects due to faulty design, materials and workmanship and shall be of an acceptable quality.
3.4 The Goods will be supplied within a reasonable period and installed with due care and skill.
3.5 Whilst we will endeavour to supply and install the Goods within the estimated delivery period and prior to the estimated installation date as specified in the Quote, we will not be responsible for any delays in supply or installation which are outside our reasonable control.
3.6 Unless specified in the Quote, we will not remove or dispose of your existing window furnishings before or after installing the Goods. We will not be responsible for patching or repairing any holes or damage to your walls or window frames, or for repainting, as a result of the removal of the existing window furnishings.
3.7 To the extent permitted by law, we expressly exclude any liability for indirect or consequential loss.
4. Your Responsibilities
4.1 It is your responsibility to ensure that the Goods and the installation are suitable for your purpose and the Premises.
4.2 You confirm that you are the owner of the Premises or you have the authority of the owner of the Premises for the installation of the Goods in the Premises.
4.3 We will rely upon any information that you provide us for purposes of providing the Quote and supplying and installing the Goods. You will be liable for any additional costs that are incurred as a result of the provision of incorrect information to us by you.
4.4 You acknowledge that the Goods may vary from the samples chosen by you due to differences in production runs and natural materials. Whilst we will make all reasonable efforts to ensure that the Goods match the samples, we will not be liable for any such variations.
4.5 You must allow us access to the Premises at the time of installation to ensure that the Premises and installation site are safe for our installer to install the Goods. Unless otherwise agreed you, or an adult person nominated by you, will be present at the Premises during the installation.
4.6 Without limiting 4.5, you must arrange for any pets which may result in a danger to the installer to be restrained or removed from the Premises prior to installation of the Goods. You must also provide us with particulars of services to the Premises including the location of any water pipes, electrical cables or any other potential hazard of any kind as required.
4.7 You must ensure that the Goods are maintained and operated in accordance with any operating instructions for the Goods provided to you by us. Product care instructions can be found on our website at: www.geccoblinds.com/product-care-instructions.
4.8 If, after the installation of the Goods you have a complaint or are unhappy with the Goods or their installation, you must allow us access to the Premises to inspect the Goods and their installation.
4.9 In the event that you fail to comply with your obligations under these terms and conditions and/or the Quote, you agree to indemnify us against any costs, expenses and liability incurred by us, except to the extent that the failure is directly attributable to the negligence or wrongful act or omission of us or our contractors.
5. Payment and Title to Goods
5.1 Prior to ordering the Goods you agree to pay us a deposit of 50% of the total price quoted. Goods will not be ordered until the deposit has been paid;
5.2 You acknowledge that the Goods will be custom made and as such once placed orders cannot be altered or cancelled.
5.3 You must pay the final balance owing to us in accordance with the conditions of payment on the Quote.
5.4 Ownership of the Goods will pass to you on the earlier of the completion of the installation of the Goods and the date on which the Goods and their installation have been paid for in full.
6. Warranty
6.1 Statutory Guarantees:
The Goods and their installation come with guarantees that cannot be excluded under the Australian Consumer Law. For example, amongst other things, the Goods must be free from defects, of an acceptable quality, fit for purpose and must be installed with reasonable care and skill. The Warranty provided in these terms and conditions are in addition to any rights which may be available to you under the Australian Consumer Law and other relevant legislation and which cannot be excluded.
6.2 Warranty Coverage:
Subject to any conditions and exclusions, Gecco Blinds warrants that the products supplied and installed by it will be of acceptable quality and free from defects due to faulty design, materials and workmanship.
6.3 Warranty Periods:
The following warranty periods apply in respect of the following products from the date of installation:
(a) Plantation Shutters: 20-year structural warranty and a 5-year paint warranty;
(b) Blinds: 5-year fabric and hardware warranty;
(c) Curtains: 2-year fabric and hardware warranty;
(d) Motors: 5-year warranty;
(e) Installation Labour: 12-month warranty.
6.4 Exclusions:
The Warranty does not apply to:
(a) Any damage to the Goods caused by accidents or the misuse, abuse or neglect;
(b) Ordinary wear and tear;
(c) Any damage caused to the Goods due to moisture (including moisture laden air) or environmental conditions, for example shrinkage, expansion, twisting or bowing and paint fading or peeling which can be attributed to environmental conditions;
(d) Any damage caused by salt or marine influences;
(e) The removal and reinstallation, or alteration of the Goods or any part of the Goods, by you. Any unauthorised work on the Goods will void the Warranty;
(f) Failure by you to follow the product care and operating instructions.
6.5 Warranty Claims:
(a) You must make any Warranty claim as soon as possible after the defect in the Goods has been discovered.
(b) You must allow Gecco Blinds to access the Premises to assess the claim onsite before any further action is taken under this warranty.
(c) Subject to the Australian Consumer Law, in the event of a valid Warranty claim we may elect at our option to replace or repair the Goods or any part of the Goods or refund the original purchase price.
6.6 Non-Transferable Warranty:
This Warranty is non-transferable and proof of purchase and payment must be provided when making a warranty claim.
